VITOUSEK: Yep. <br /> WESLEY-SMITH: Has Oceanside approached the development of Hokuli`a differently than the <br /> original developer? <br /> VITOUSEK: Absolutely, I mean—our primary goal is building community relationships, fixing <br /> the problems that have been left for us, and making sure that we're in compliance with all aspects <br /> of the project. <br /> WESLEY-SMITH: Okay, so I want to run—there's been mentioned in the briefs about—or a <br /> suggestion that Oceanside is trying to avoid providing public benefits, so just real briefly, I want <br /> to run through some of the public benefits. So, let's talk first about the bypass—Derek can we <br /> bring up exhibit twenty please? And Mike, in the meantime, could <br /> WAN: Could you clarify which— <br /> WESLEY-SMITH: Exhibit twenty from case PL-BOA-2024-000104. <br /> WAN: PL-BOA-2024-000104, thank you. <br /> WESLEY-SMITH: PL-BOA-2024-000104, yeah and Mike in the meantime, could you describe <br /> what Oceanside contributed to the bypass. <br /> VITOUSEK: Sure, so the original developer 1250 Oceanside Partners constructed the bypass <br /> between Keauhou and Halekii Ahupua'a and then when we came on in 2014, we contributed <br /> twenty million dollars to the County in order to complete the bypass requirements from Halekii <br /> to Ka`awaloa and Napo'opo'o intersection. <br /> WESLEY-SMITH: And that bypass is the one shown in orange or yellow. <br /> VITOUSEK: Yeah, gold—maybe. <br /> WESLEY-SMITH: Okay and in your experience, does the public use the bypass regularly? <br /> VITOUSEK: Oh, absolutely. Yeah, it definitely served to resolve some major regional <br /> connectivity and traffic issues. <br /> WESLEY-SMITH: Okay, let's talk about the shoreline park. As it sounds like, it's basically that <br /> entire shoreline area running the whole length of the project. How many acres is the shoreline <br /> park? <br /> VITOUSEK: The shoreline park is one hundred forty acres of conservation zoned land. <br /> WESLEY-SMITH: Can the public access the shoreline park? <br /> BAILEY: I'm going to object as to relevance as to these declaratory orders before you today. <br /> LEWIS: I'm going to sustain this time. <br /> WESLEY-SMITH: Okay. <br /> LEWIS: Yeah, let's get a little more honed in on the actual issues. <br /> EXHIBIT B <br /> Page 12 <br />
