LEWIS: Go ahead. <br /> WESLEY-SMITH: So, Mike based on your experience on the Leeward Planning Commission, do <br /> you have any knowledge about community plans in this area? <br /> VITOUSEK: Yes. <br /> WESLEY-SMITH: And based on your knowledge of community plans, do you know that in the <br /> 1990's whether there was a vision for different development in this area? <br /> VITOUSEK: My understanding is in the 1990's, there was not the same level of restrictions that <br /> are placed on that area as there are today through the Kona Community Development Plan. <br /> WESLEY-SMITH: And based on your role with Oceanside, isn't it true that in the 1990's <br /> Oceanside was planning to develop the Ackerman Ranch and properties to the north. <br /> LEWIS: You're leading your own witness, don't lead your own witness. <br /> WESLEY-SMITH: Okay. <br /> LEWIS: If he knows— <br /> VITOUSEK: Yeah, so I am—I am aware of Oceanside Partners prior plans to develop this region. <br /> Those master plans are available in our files, I'm very familiar with them. Oceanside Partners did <br /> plan to develop Ackerman Ranch as phase four of Hokuli`a that was included as property that they <br /> had previously owned, that was lost during the bankruptcy. They also had plans to develop the <br /> property to the south, Keopuka under a different development name of Pacific Star, so they were <br /> multiple development plans by the same previous entity to develop other properties in this region. <br /> WESLEY-SMITH: So, in the 1990's Hokuli`a's the original developer planned to develop both to <br /> the north and to the south of Hokuli`a. <br /> VITOUSEK: That's correct. <br /> WESLEY-SMITH: And so,what was the role of the connector road in—in all of this development? <br /> VITOUSEK: The connector road was intended to serve those properties as a connection between <br /> them, amongst them. Provide connectivity between the different developments and—with the <br /> increased density of the surrounding area, to provide limited through traffic in order to take the <br /> pressure off of the bypass highway. <br /> WESLEY-SMITH: So, do you believe that the connector road would have been extended into the <br /> developments north and south. <br /> BAILEY: Objection calls for speculation. <br /> LEWIS: I'll sustain. <br /> WESLEY-SMITH: Mike, has anything changed based on your knowledge regarding development <br /> plans at present? <br /> VITOUSEK: Yes. <br /> EXHIBIT B <br /> Page 15 <br />
