COUNTY OF HAWAII <br /> OFFICE OF THE MAYOR <br /> RULE 1 DEVELOPMENT AGREEMENTS <br /> 1--1 Authority <br /> This rule implements the procedures for the application, <br /> preparation and administration of Development Agreements in <br /> the County of Hawaii as provided by Chapter , Hawaii County <br /> Code (Ordinance No. 93-37) . which authorizes the Office of <br /> the Mayor to negotiate, prepare and administer Development <br /> Agreements and to make such rule pursuant to Chapter 91, <br /> Hawaii Revised Statutes . <br /> 1-2 Scope and Purpose <br /> The purpose of this rule is to ensure that a person who enters <br /> into a Development Agreement with the County of Hawaii may <br /> proceed to develop the project in accordance with the <br /> provisions of Ordinance No. 93-37. Further the County of <br /> Hawaii may enter into such agreements to ensure the commitment <br /> for on-site and off--site development requirements necessary to <br /> preserve the public health, safety and welfare. <br /> ] Definitions <br /> As used in this rule, words and phrases shall have the same <br /> definition as provided for in Ordinance No. 93-37, except as <br /> follows or as otherwise recognized by context : <br /> EXHIBIT 11 <br />
