The interior consists of kitchen facilities, separate interior and lanai dining areas, a bar area <br />with stools, storage space, and separate men and women restrooms for its customers and <br />employees. For further information, refer to the floorplan attached as Exhibit 4. <br />Street parking is limited, however there are several nearby parking lots available along Ali `i <br />Drive. <br />KIND OF BUSINESS: Applicant continues to operate as a contemporary casual restaurant <br />offering a variety of fresh seafood, steaks and island cuisine. <br />Applicant is open seven (7) days a week from 10:00 a.m. — 9:00 p.m. <br />Employment consists of approximately fifty-one (51) employees, twelve (12) of which are <br />certified by the Department of Liquor Control to supervise the sale, service and consumption of <br />liquor. <br />Applicant currently has live entertainment in the form of a soloist once or twice a week during <br />inner hours. <br />MANNER OF OPERATION: The current licensee, Wind & Sea Restaurants, Inc. dba Kona <br />Inn Restaurant has had no violations and has operated in a reputable manner. <br />ASSIGNMENT AND ASSUMPTION OF LEASE: This Assignment and Assumption of <br />Lease ("Assignment and Assumption Agreement"), dated March 25, 2026, by and among Wind <br />& Sea Restaurants, Inc., ("Assignor"), Kona Inn Restaurant, LLC ("Assignee") and Kailua Kona <br />Village Development Group LLC ("Landlord"), hereby sells, assigns, transfers, and sets over <br />unto Assignee all of Assignor's right, title and interest in, to and under the Restatement and <br />Amendment of Lease dated November 17, 2014 ("Lease"), by and between Assignor and <br />Landlord, for certain premises located at 75 -5 744 Ali `i, Kailua-Kona, HI. <br />RESTATEMENT AND AMENDMENT OF LEASE: This Restatement and Amendment <br />("Amendment") dated November 17, 2014, by and between Kailua Kona Village Development <br />Group, LLC ("Landlord") and Wind & Sea Restaurants, Inc. ("Tenant"), that certain space <br />number 21 ("Kona Canoe Club") in the KONA INN SHOPPING VILLAGE, and that certain <br />space 135 ("Kona Inn Restaurant") in the KONA INN SHOPPING VILLAGE shall be for a term <br />of twenty (20) years commencing on September 1, 2014, and terminating on August 31, 2034. <br />There shall be no automatic option to extend the term of the lease. <br />TEMPORARY LIQUOR LICENSE: A temporary liquor license was issued with the effective <br />date of March 25, 2026 and was ratified by the commission on April 2, 2026. <br />ZONING : Resort -Hotel <br />
