RECORD ON APPEAL
Appellee DEPARTMENT OF PUBLIC WORKS, COUNTY OF HAWAPI ("Public
Works"), by and through its attorney, Sinclair Salas-Ferguson, Deputy Corporation Counsel,
hereby submits Public Works' record on appeal for the above-captioned matter.
A. RECORD ON APPEAL
Pursuant to Board of Appeals Rules 3-13(h) and 1-3(21), the following documents are
directly related to the decision that is being appealed:
1. A copy of a complaint dated December 8, 2020, which reports an unpermitted rock
wall and unpermitted"structural alterations" at 75-5968 Alii Drive, TMK: (3) 7-5-
019:023 ("Kismet's Property").
2. A copy of the March 3, 2021 Notice of Violation issued by Public Works to Kismet,
LCC, which details the following unpermitted work at Kismet's Property:
1) construction of a rock wall;
2) replacement of banisters and railings;
3) extension of roof lines;
4) installation of support posts;
5) removal and replacement of windows and doors;
6) removal and replacement of wall and ceiling surfaces;
7) renovations of flooring, cabinets, and walls; and
8) construction of an office building; and construction of a pool.
3. A screen shot of Kismet, LLC's permit that was filed with Public Works to address
the issues detailed in the Notice of Violation. The permit description states that
Kismet, LLC will:
1) Replace exterior railings;
2) Replace termite eaten wood;
3) Replace cabinets and drywall;
4) Paint the roof over the mauka stairs;
5) Replace gutters, windows, and doors; and
6) Replace flooring.
Kismet, LLC's permit does not address the unpermitted pool, rock wall, or office
building and it does not call for renovations of bathrooms.
4. A copy of the February 26, 2026 Notice of Order ("Order") addressed to Kismet,
LLC. The Order notifies Kismet, LLC that on January 14, 2026, Public Works
inspected Kismet's Property and found that Kismet, LLC did not obtain a permit for
its rock wall, swimming pool, or office building. Furthermore, Public Works saw that
Kismet, LLC renovated its bathrooms without first obtaining a permit.

On January 14. 2021,the Department of Public Work,' Building Division inspected the
property located at 75-5968 A1i`i Drive and TMK(3)-7-5-0t9:019 &023 and observed the
following violations.
The Hawaii County Code Sections that were violated and the nature ortlie violations are:
1. I ICC Section 5-3-1 . Permit required;generally.
Construction andfor alterations were done without the required permits.
2. HCC section 5-10-1 . Violations.

occupy, or maintain any building or structure, or cause or authorize the same to be done in violation
of the construction Lode, including but not limited to chapter 5A; the building code, 5D:the electrical
code andJor 5F: the plumbing code.
On January 14,2026, the Department of Public Works' Building Division inspected the property
located at 75-5968 A11H Drive and TMK(3)-7-5-019:019& 023 under building permit PW.B2023-
004522 and observed the following was missing from the description of work on the permit=
1. Unperm hied construction of rock walls on pages 6 & 7 of the NOV dated March 3,2021.
2. All bathrooms Deceived a total renovation upon inspection on January 14, 2026, which are not on
the descrlptloil of work on PW.B2023-004522.
3.The temporary office now used as a reception area that is now connected to the hotel at tiie
roofjine still hasn't gotten a permit as noted on pages 15 and 16 of the NOV dated March 3,2021 ,

ORDER
You failed to comply with the Notice of Violation, Dated March 3, 2021; therefore,you are
hereby ordered to do the Following, within 30 days of tlhe date of this Order
SELECT ANY OR ALL OF THE FOLLOWING:
(1) Cease and desist from the violation, including but not limited to, immediately stopping all
work whether for failure to obtain a required permit nr for violation of the requirements of any
permit or variance issued pursuant to the construction code;
(2) Correct the violation,at the party's own expense, belore a date specified in the order;
(3) Provide the authority having jurisdiction with periodic progress reports detailing corrective
measures taken to correct the violation by specified deadlines;
(4) [lay a civil fine of$1, 000.00 by check made payable to the County Director of Finance and
mailed to the Department of Public Works, Building Division at 74-5044 Ane Keohokalole. Hwy,
Kailua-Kona, Hawaii 96740.
If you fail to comply with the order above, you will be assessed a civil fine of$1,000.00 per day
for each day in which the violation persists, beginning 30 days afler the date of this Order. The
daily fines are due at the end of each month and shall be made by check, payable to the County
Director of Firiarice and mailed to the Department of Public Works, Building Div is'toil at 74..

writing on or before the date the order becomes final.

required to comply with the order from the date that they receive the order.
