RECORD ON APPEAL Appellee DEPARTMENT OF PUBLIC WORKS, COUNTY OF HAWAPI ("Public Works"), by and through its attorney, Sinclair Salas-Ferguson, Deputy Corporation Counsel, hereby submits Public Works' record on appeal for the above-captioned matter. A. RECORD ON APPEAL Pursuant to Board of Appeals Rules 3-13(h) and 1-3(21), the following documents are directly related to the decision that is being appealed: 1. A copy of a complaint dated December 8, 2020, which reports an unpermitted rock wall and unpermitted"structural alterations" at 75-5968 Alii Drive, TMK: (3) 7-5- 019:023 ("Kismet's Property"). 2. A copy of the March 3, 2021 Notice of Violation issued by Public Works to Kismet, LCC, which details the following unpermitted work at Kismet's Property: 1) construction of a rock wall; 2) replacement of banisters and railings; 3) extension of roof lines; 4) installation of support posts; 5) removal and replacement of windows and doors; 6) removal and replacement of wall and ceiling surfaces; 7) renovations of flooring, cabinets, and walls; and 8) construction of an office building; and construction of a pool. 3. A screen shot of Kismet, LLC's permit that was filed with Public Works to address the issues detailed in the Notice of Violation. The permit description states that Kismet, LLC will: 1) Replace exterior railings; 2) Replace termite eaten wood; 3) Replace cabinets and drywall; 4) Paint the roof over the mauka stairs; 5) Replace gutters, windows, and doors; and 6) Replace flooring. Kismet, LLC's permit does not address the unpermitted pool, rock wall, or office building and it does not call for renovations of bathrooms. 4. A copy of the February 26, 2026 Notice of Order ("Order") addressed to Kismet, LLC. The Order notifies Kismet, LLC that on January 14, 2026, Public Works inspected Kismet's Property and found that Kismet, LLC did not obtain a permit for its rock wall, swimming pool, or office building. Furthermore, Public Works saw that Kismet, LLC renovated its bathrooms without first obtaining a permit. WESLEY R.
