A. RECORD ON APPEAL <br /> Pursuant to Board of Appeals Rules 3-13(h) and 1-3(21), the following documents are <br /> directly related to the Director's decision that is being appealed: <br /> 1. A copy of six "Declaration[s] of Compliance [with] HRS Section 46-88 Relating to <br /> Agricultural Structures" submitted by I'O Processing to Public Works, dated <br /> December 30, 2022 (HRS § 46-88(5) requires a person seeking a building permit <br /> exemption for certain agricultural buildings to submit written notice to the County <br /> prior to commencing work). <br /> 2. A copy of an email string, where the latest email is dated January 13, 2023; in the <br /> email, DPW informs I'O Processing that its structures do not qualify for building <br /> permit exemptions under HRS § 46-88. <br /> 3. A copy of an email string, where the latest email is dated February 10, 2023; in the <br /> email, DPW informs I'O Processing that per HRS § 46-88, in order to be exempt, <br /> manufactured pre-engineered commercial buildings or structures must comply with <br /> appropriate county codes and have been pre-approved by a county or building <br /> official. <br /> Dated: Hilo, Hawai`i, September 13, 2024 STEPHEN M.
