To: Board of Appeals for Planning and Pubic Works, Hawaii <br />County <br />From: Gary Rosenberg, 17-4722 South Road, Kurtistown HI <br />96760 <br />Cell: 510-849-9808 <br />Re: Appeal of variance granted PL-2026-000080, TMK: (3) 1-7- <br />023:016 <br />Members of County Appeals Board: <br />After extensive discussions with our neighbors consensus is it is <br />inappropriate and unsafe to extend a variance to enable the <br />subdivision of TMK: (3) 1-7-023:16 without bringing North Ala <br />road into compliance with current County standards for residential <br />subdivisions. <br />This corner lot and the corner of South Road and North Ala Road <br />under current conditions possess a hazard - specifically the <br />potential of young children on bicycles. Under existing conditions <br />it is necessary to negotiate passage with oncoming traffic, in my <br />experience almost every time I leave or return home. <br />As the legal owner of South Road, I have expressed my concerns <br />over the safety of our community with the owner/developer who <br />responded by threatening to gate off the road to all through traffic. <br />Our mixed use neighborhood is comprised of agricultural, <br />commercial and residential lots.
