1. On May 1, 2025, Appellant submitted <br />a General Petition for Appeal of <br />Decisions by Planning Director or <br />Public Works Director to the Board of <br />Appeals, County of Hawai'i ("Board") <br />appealing the Planning Director's <br />Special Management Area exemption <br />determination and a related building <br />permit issued by the Public Works <br />Director. Appellant amended the <br />Petition to separate the Planning <br />Director and Public Works Director <br />appeals. <br />5 <br />Rohr objects on the grounds that Fact 1 <br />does not accurately reflect the procedural <br />history that explains why there are two <br />related cases. <br />Racnrd fni-te- <br />l.On May 1, 2025, Appellant Claudia Rohr <br />filed a Petition for Appeal of a Decision by <br />the Planning Director to issue an SMA <br />exemption determination for a building <br />permit, based on SMA assessment <br />application No. PL-SAA-2025-000280, and <br />a Decision by the Department of Public <br />Works Director to issue Building Permit <br />No. PW. B2024- 005123 before the <br />Planning Director's exemption <br />determination was made. <br />By Letter dated May 7, 2025, Appellant <br />was informed by the Board's staff that her <br />Petition was defective, that a General <br />Petition can be filed to appeal a Director's <br />decision of the Planning Department or the <br />Department of Public Works, in the <br />singular. Appellant was instructed to <br />correct a defective petition by filing <br />separate petitions within 30 days. <br />On May 31, 2025, Appellant Rohr filed her <br />Amended Petition in case No.PL-BOA- <br />2025-000119, appealing the Decision by <br />the Planning Director to issue a SMA <br />exemption determination based on SMA <br />assessment application PL-SAA-2025- <br />000280 and attached building plans that <br />lacked an off-street parking plan to the <br />standards STVRs are required to construct. <br />Rohr opened a new case on EPIC and filed <br />a separate Petition appealing the Director of <br />Public Works' decision as case No.PL- <br />ROA-2025-000121. <br />
