8. By Order for Continuance and Amended <br />Scheduling Order dated January 6, 2026, <br />the Board Chairperson allowed the filing of <br />the Second Amended Petition and <br />continued the hearing date until March 13, <br />2026, due to the Appellant's failure to send <br />the BOA Rule 8-11(d) notice to <br />Second Amended Petition on Appeal <br />permitted under BOA Rul Rule 2-4(f). <br />January 5, 2026, Jean Campbell, counsel <br />for the Planning Director objected to the <br />second amended petition by email, <br />claiming: <br />No additional filings are permitted <br />by either the Scheduling Order or <br />the BOA Rules of Practice and <br />Procedure. No procedural rule <br />allows for this filing nor does it <br />recite any authority by which it may <br />be filed, thus i[t] must be rejected in <br />its entirety and disregarded by the <br />BOA. <br />Rohr responded by pointing out BOA Rule <br />2-4(f).
