I am officially notifying the county of a gross violation within O'oma Plantation regarding the property at 73-1415 Kukuna Street, Kailua Kona owned by Kimberly and Kainoa Pabre. They have installed a massive rooster farm/shelter and outbuildings within 75ft of of property lines. This is a gross violation and needs to be remedied immediately. Please find attached our officially signed and dated Zoning Violation Compliant. I am the neighbor directly next to him and despite multiple attempts by owners and HOA to remedy it is met with hostility and anger, in some cases threatening which have all been reported to Hawaii Police. "Rooster Teepees" as Fnclosures M8 Chapter 25 regulates structures based on their function. Any structure used for the sheltering, housing, or confinement of animals —regardless of its form or permanence —may be considered an enclosure under the Code. Applicability of HOA CC&Rs County zoning regulations and private Homeowners Association (HOA) Covenants, Conditions, and Restrictions (CC&Rs) operate independently. Here, the enclosures at issue are for the housing and keeping of chickens, and thus, the structures should be located at least seventy-five (75) feet from any lot line.
