F@ APPLICABILITY <br />The Hawaii County Ethics Code, Article 15, Sections 2 -79 through 2 -91.6, applies to you if you are a County officer or employee. Officers <br />include the Mayor, members of the Council, and any person elected or appointed as administrative head, deputy or division chief of any agency <br />of the County, or appointed as a member of any board or commission provided for in the Charter. An employee is anyone (other than an <br />officer) who is employed by the County or any County agency, but does not include independent contractors. Hawaii County Charter <br />Section 13 -1. <br />LEI GIFTS <br />You may not solicit or accept a gift under any circumstance in which it can reasonably be inferred that the gift is intended to influence you, as <br />an officer or employee, in the performance of your duties or intended as a reward for any official action on your part. Hawaii County Code <br />(HCC) Section 2- 91.1.4. <br />You must file a gifts disclosure statement with the Board of Ethics on June 30 of each year if: <br />1) You, a spouse or dependent child receives from one source any gift or gifts whose aggregate value exceeds $100; and <br />2) The source of the gift(s) has interests that may be affected by official action that you take; and <br />3) The gift is not exempted by the Code from the reporting requirements. HCC Section 2- 91.5(a). <br />H CONFIDENTIAL INFORMATION <br />You may not disclose or use confidential information acquired in the course of your employment for your personal gain or the benefit of others. <br />HCC Section 2 -91.6. <br />H FAIR TREATMENT <br />You may not use your County position to secure or grant unwarranted privileges, exemptions, advantages, contracts, or treatment, for yourself <br />or others.
