2.5 Consideration and Disposition of Petition <br />a. Within thirty working days, which period shall commence <br />on the next day following the Board's monthly meeting <br />during which the Board considers the petition, the Board <br />shall: <br />(1) Deny the petition in writing, stating its reasons <br />for denial; or <br />(2) Initiate proceedings in accordance with law for the <br />adoption, amendment, or repeal of the rule, as the <br />case may be. <br />RULE 3. DECLARATORY RULINGS <br />3.1 Who May File <br />a. Any person, officer, or employee may petition the Board <br />for a declaratory order as to the applicability of any <br />statute, ordinance, rule, or order of the Board. <br />3.2 Form and Content of Petition <br />a. One original and seven copies of the petition shall be <br />submitted to the Board. It shall contain: <br />(1) The name, address, and telephone number of the <br />petitioner. <br />(2) A statement of the nature of petitioner's interest, <br />including reasons for the submission of the petition. <br />(3) A designation of the specific statute, ordinance, <br />rule, or order in the question. <br />(4) A complete statement of facts. <br />(5) A statement of the position or contention of the <br />petitioner. <br />(6) A memorandum of authorities, containing a full <br />discussion of the reasons, including any legal <br />authorities, in support of such position or <br />contention. <br />(7) The signature of the petitioner or his personal <br />representative. <br />-7- <br />
