CHAIR: Likewise a good suggestion. I think we'll dig into this in some depth. And <br />again —(TAPE ENDED NEW TAPE INSERTED) <br />KK: I'd sure like to take another crack at, you know, this last paragraph here. Are you <br />implying that if a person gives $5 to a campaign, it's slightly problematic, <br />whether it's the mayor's campaign, or governor's campaign, or what? Isn't that <br />why you set a the law sets a plateau, "x" amount of dollars? <br />FRANKEL: Let me answer that question. There's a difference between the mayor and the <br />prosecutor. The prosecutor has sole discretion to take enforcement action, and I <br />thinkI think it's <br />KK: - -so he shouldn't receive any - -any campaign contributions, then. <br />FRANKEL: I have to say it is potentially trouble. We don't let judges collect money. Our <br />state is a state. We don't elect judges. In other states they do. I think <br />it's quite- <br />KK: - -which is problematic. <br />FRANKEL: Quite problematic. I think the same issues arise when you're dealing with a <br />prosecutor, because of the issue of prosecutorial discretion. You know, it's an <br />issue that's beyond what we're here to discuss today, but I do think it is <br />problematic, because of the —you know, you look at the people who have <br />discretionary authority in government are appointed. . They haven't <br />received campaign contributions. The planning director, who makes discretionary <br />decisions, whatever, planning commission members. It is problematic when the <br />person who's in charge of enforcing —they collect money from someone that they <br />were to enforce against, whether it's —you know, if I'm a kidnapper or robber or <br />whatever and I'm giving money to the prosecutor, you know, everybody's heads <br />would just —woe, you know. Anyway. <br />CHAIR: Well, I think we're running far astray here. I think we need to have a motion <br />made to defer action pending further research and continue with counsel, a closer <br />reading of the law in regards to the and involving the County Office <br />of the County Clerk. Then we should meet again to discuss <br />registering as a lobbyist and other matters, other persons, other professions, other <br />people having dealings with government, County government. Do I have such a <br />motion? <br />WJ: I'd like to make a motion to defer to the next meeting and have the Corporation <br />Counsel write up recommendations. <br />CHAIR: Any seconds? <br />KI: Second. <br />CHAIR: Any further discussion?
