FRANKEL: You are the court. We were taking about the courts, you are basically the court. <br />KK: Yeah, I'm, it seems to be a function court. <br />BLT: Well, part of it is because under the County Code, you can provide these advisory <br />opinions, both informal and formal, and also you can render decisions upon <br />petitions that have been filed by members of the public. And in this case you <br />have a petition that has been filed by Mr. Frankel, asking you to render a <br />determination as to the specific provisions of the County Ethics Code, and that is <br />within your jurisdiction. <br />KK: I was more under the impression that we render advisory opinions, which is, in <br />my interpretation, not interpreting the law per se. <br />CHAIR: It doesn't have binding authority. We have no legal binding authority. <br />BLT: On formal opinions you do. <br />CHAIR: Oh, formal opinions. <br />BLT: . See basically, it's kind of like if somebody doesn't abide by your <br />informal opinion, you do have authority to basically follow through on that and <br />refer them for further action, because it is a violation. There are, within the Code, <br />certain actions that you can do. <br />CHAIR: All right. So I'm looking for a motion to defer action pending on <br />compatibility, State and County, primarily affecting the spousal interests, so we <br />can then be armed, take action, and come back to Mr. Frankel at a subsequent <br />meeting, and <br />BLT: - -and Mr. Chairman, please forgive me for interjecting. I just want to make sure <br />that our office knows what we're being asked to do. <br />CHAIR: Yes. <br />BLT: Mr. Frankel also raised the issue of whether County employees who file financial <br />disclosures have to list their basically, their deferred compensation and where it <br />is defer a portion of their income through Island Savings Plan and the <br />moneys invested in a mutual fund—whether that's something that has to be listed <br />on their financial disclosure. <br />CHAIR: Well, earlier we said we're looking primarily at spousal interest and property, not <br />to include —not to include savings, investments, as far as . In that <br />that is, now, if your source of income is as a registered lobbyist, clearly that's, <br />that's a fact bearing on the problem, I should think. <br />25 <br />
