4. COMMUNICATIONS <br />a. Communication No. 2008 -_: Informal Advisory Opinion for Petition No. <br />2008 -8 regarding Councilmember Emily Naeole. <br />Motion and vote: Ms. Lum moved to accept the opinion for signature, Ms. Nicholson <br />seconded the motion, and all members voted aye. The Chair signed off on the original Informal <br />Advisory Opinion. <br />5. NEW BUSINESS <br />a. Petition No. 2008 -9: Regarding Fire Inspector Bobby Perreira, alleging that <br />he violated Sections 2 -83 (fair treatment) and 2 -84 (conflicts of interest) of <br />the Code of Ethics. <br />LUM: At this point I would like to add in Section 2 -91.4 onto that. <br />CHAIR: Okay. Do we need a motion for that? <br />LUM: We could move— <br />CHAIR: - -Okay, clarify that you want to add— <br />L UM: - -It seemed to me that it would be appropriate to consider that in this whole <br />hearing, so I move that we add that into the petition. It's 2 -91.5 on gifts. <br />CHAIR: Okay, just to clarify that the petitioner, Ivan Takamoto, did not reference that <br />section of the Code of Ethics in his petition. He specifically referenced Section 2 -83 and <br />2 -84. Since we are discussing what this petition applies to, 1—well, before we begin, I'd <br />like to disclose that I do know Mr. Perreira from past projects that I worked on up at the <br />Hilo Hospital. We did two projects, one at the veterans' home and one at the emergency <br />room, and at some point during that project we did need an inspection and we also <br />needed an opinion on some code issues. I think the extent of my communication with him <br />was possibly a phone call or two and maybe an email or a letter, but there is nothing <br />outstanding for that project, and I feel I can kind of preside over these issues without any <br />kind of bias or undue influence. So I have no issues whatsoever with that. Do you guys <br />have any comments? <br />L UM: No. <br />NICHOLSON: No. <br />CHAIR: Okay, so continuing on— <br />L UM: - -Was that a motion, that we add that in, or I'm just doing it? <br />2 <br />
