EXECUTIVE SESSION (closed to the public – separate minutes prepared) <br />The Board returned to Regular Session to vote at 11:43 a.m. <br />Motion and vote: Mr. Martin moved to accept and file the three financial disclosures <br />which were reviewed. Ms. Lum seconded the motion, and all members but Ms. Gentry voted <br />aye. Ms. Gentry abstained, since she had provided one of the disclosures. <br />S. ANNOUNCEMENTS <br />SCHOEN: Mr. Chair, before we adjourn, I would just like to seek clarification on this <br />Board's instructions to me regarding this Board's response to Mr. Cole's letter dated <br />December P. It was my understanding that this Board wanted me to communicate to <br />Mr. Cole via letter that you will only look at a possible ethical violation with respect to <br />the allegation against Councilmember Naeole, "in her official capacity, did not treat me <br />in a courteous, fair and impartial manner, and is therefore in violation of Article 15, <br />Code of Ethics, Section 2 -83, Fair Treatment, " subsection (a)(3), and I'm quoting from <br />his communication dated December 1St. Is that correct? <br />CHAIR: Yes. <br />L UM: And only that one, and the backup materials for only that. <br />SCHOEN And he —Mr. Cole references, I believe, Ms. Naeole calling him "whacky. " <br />Is that the one- <br />NICHOLSON: Actually, it's a quote from a newspaper article in West Hawai `i Today <br />written by Quirk— <br />L UM: Jim Quirk- <br />NICHOLSON - -Jim Quirk, so we don't actually have anything other than sort of <br />secondhand information. So I think we have no —even no evidence that that happened, so <br />I guess in order for us to— <br />L UM: - -the context or anything else- <br />NICHOLSON - -to consider it.further, we would need some sort of verification that that <br />happened and what the context that that happened is. <br />29 <br />
