CHAIR: I'd like to call for a motion for an informal advisory opinion from the Board <br />regarding Petition No. 2009 -6, finding that Councilwoman Emily Naeole was not in <br />violation ofHawai `i County Code Section 2- 83(a)(3) or (b) (5). <br />MARTIN: I so move. <br />NICHOLSON: I second. <br />CHAIR: Any further discussion? Petition No. 2009 -7: Petitioners allege that a County officer or employee <br />violated Section 2- 83(a)(3) of the Code of Ethics (regarding fair treatment) <br />by making "insulting gestures during the time of testifiers exercising their <br />constitutional First Amendment rights to free speech." <br />CHAIR: All right. Moving on to Petition No. 2009 -7, we're going to handle this in the <br />same way. It is in reference to the same section of the Ethics Code, Section 2 -83, except <br />it is isolated to Section (a) (3), correct? <br />SMITH: Yes. <br />CHAIR: Okay, Joyce, Gregory, please come up. <br />FOLENA: Mr. Dill, I have a question about your ruling just now? <br />CHAIR: Yes. <br />FOLENA: Since 2009 -6 had a list of a total of fourteen violations <br />CHAIR: I see, I see. Yeah, I see what you're saying. <br />FOLENA: Yeah, what about the rest of them? <br />CHAIR: We are <br />FOLENA: - -the rest of the violations? <br />CHAIR: - -what we're doing is referencing the petition, which includes all those <br />violations.
