CHAPTER BACKGROUND <br />(c) In implementing this chapter, the department and each county shall consider the <br />minimization of litter and illegal dumping as a design factor in the development <br />of integrated solid waste management programs." <br />HRS §342G -3, "Goals," provides, in pertinent part: <br />"(a) It is the goal of the State to reduce the solid waste stream prior to disposal by: <br />(1) Twenty -five per cent by January 1, 1995; and <br />(2) Fifty per cent by January 1, 2000; <br />through source reduction, recycling, and bioconversion. Where feasible, the office shall <br />establish other state goals for specific commodities, recognizing market <br />considerations." <br />HRS §342G -12 provides for the establishment of the Office of Solid Waste Management within the <br />State Department of Health (DOH). <br />HRS chapter 342G, part III, "Integrated Solid Waste Management Planning," establishes the <br />requirement that each county develop an "integrated solid waste management plan," and sets forth the <br />process for obtaining DOH plan approval including minimum program component requirements and <br />schedules for plan submission. The program components that directly relate to the scope of this audit <br />are set forth in: <br />HRS §342G- 25(b)(2) - <br />Source reduction <br />HRS §342G- 25(b)(3) - <br />Recycling and bioconversion <br />HRS §342G- 25(b)(5) - <br />Special waste <br />HRS §342G- 25(b)(6) - <br />Household hazardous waste <br />HRS §342G- 25(b)(7) - <br />Public education and information <br />HRS §342G- 25(b)(10) - <br />Program implementation <br />HRS §342G- 25(b)(11) - <br />Program funding. <br />HRS § 10313-1 02(b)(2)(A) and (I) of the Hawaii Procurement Code provide: <br />"(b) Notwithstanding subsection (a), this chapter shall not apply to contracts by <br />governmental bodies: <br />(2) To disburse funds, irrespective of their source: <br />(A)For grants or subsidies as those terms are defined in section 42F -101, <br />made by the State in accordance with standards provided by law as <br />required by article VII, section 4, of the State Constitution; or by the <br />counties pursuant to their respective charters or ordinances... <br />(I) For contracts awarded in accordance with chapter 103F...." <br />Hawaii Administrative Rules (HAR), Title 11, Chapter 58.1, "Solid Waste Management Control," <br />establishes minimum standards governing the design, construction, installation, operation, and <br />maintenance of solid waste disposal, recycling, reclamation, and transfer systems. <br />3 <br />
