Section 20-54. Summons or citation for violation. A police officer shall use a form of summons or citation provided by the County in citing a violator of any provision of this article. Section 20-55. Penalty. (a) _Any person who violates the provisions of this article shall, upon conviction,be sentenced to pay a fine of not more than$1,000 and/or not more than 200 hours of community service for each offense and shall be required to remove their plastic ba sgor shall be liable for the costs of removing the plastic bags. (b) Each day of violation shall constitute a separate offense. (c) Fines collected pursuant to this chapter shall be deposited into the public access, open space, and natural_resources fund, as authorized by section 2-214(b)(3),which permits monies to be deposited to the fund_from"any source Of revenue_dedicated by the Hawaii County Charter or the Hawaii County Code for the purposes of this article."" SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end,the provisions of this ordinance are declared to be severable. SECTION 4. New material is underscored. In printing this ordinance,the underscoring need not be included. SECTION 5. This ordinance shall take effect upon approval.
