COUNTY OF HAWAII <br />�4 <br />N <br />STATE OF HAWAII <br />BILL NO. 27 <br />ORDINANCE NO. 05 30 <br />AN ORDINANCE AMENDING CHAPTER 19, ARTICLE 8, SECTION 19 -60, OF THE <br />HAWAII COUNTY CODE 1983 (1995 EDITION), RELATING TO COMMERCIAL <br />AGRICULTURAL USE DEDICATION. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. The purpose of this measure is to amend section 19 -60, <br />Commercial Agricultural Use Dedication, of the Hawai'i County Code 1983 (1995 <br />edition), to allow for a one -time extension for filing of commercial agricultural use <br />dedication for the 2005 -2006 tax year to accommodate the end of the year passage of <br />Ordinance No. 04 -143. Ordinance No. 04 -143 was enacted on December 8, 2004, <br />which was after the September 1 deadline for filing of commercial agricultural use <br />dedication. This measure will allow those in the agricultural industry to take advantage <br />of the agricultural use dedication in the 2005 -2006 tax year. <br />SECTION 2. Chapter 19, article 8, section 19 -60, of the Hawai'i County Code <br />1983 (1995 edition), is amended by amending subsection (d) to read as follows: <br />(d) Commercial Agricultural Use Dedication Petition. <br />(1) If any owner desires to dedicate his or her land for a commercial <br />agricultural use and to have his or her land taxed as its assessed <br />value in this use, the owner shall so petition the director of finance <br />and declare in the petition that his or her land can best be used for <br />
