COUNTY OF HAWAII ORDINANCE NO. G6' STATE OF HAWAII BILL NO. 267 86 Draft 2 AN ORDINANCE AMENDING CHAPTER 25, THE HAWAI'I COUNTY CODE 1983 (2005 EDITION. AS AMENDED), RELATING TO SEWER PUMP STATION. BE IT ORDAINED BY TIIE COUNCIL OF THE COUNTY OF IIAWAI'L SECTION 1. Purpose. A sewer pump station is not specifically mentioned as a permitted use in any of the zoning district. Such a facility is normally a necessary function of a larger development; and therefore, should be permitted within the various zoning districts under the category of public and private utilities. SECTION 2. Chapter 25, article 4, section 25-4-11, Hawai'i County Code 1983 (2005 Edition, as amended) is amended to read as follows: "Section 25 -4 -11. Power lines[;], utility substations[;], public buildings. (a) Communication, transmission, and power lines of public and private utilities and governmental agencies are permitted uses within any district. (b) Any substation used by a public or private utility for the purpose of furnishing telephone, gas, electricity, water, sewer, radio, or television shall be a permitted use in any district provided that the use is not hazardous or dangerous to the surrounding area and the director has issued plan approval for such use. (c) Public uses, structures and buildings and community buildings are permitted uses in any district, provided that the director has issued plan approval for such use." SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included.
