COUNTY OF HAWAII <br />STATE OF HAWAII <br />BILL NO. 147 <br />Draft 2) <br />ORDINANCE NO. 07 2 <br />AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, SECTION 15 -7, OF THE <br />HAWAII COUNTY CODE 1983 (2005 EDITION), RELATING TO PARKS AND <br />RECREATION. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L <br />SECTION 1. The purpose of this measure is to amend chapter 15 (Parks and <br />Recreation) by changing the imprisonment penalty from ninety days to thirty days. Possible <br />penalties will remain, imposition of a fine, imprisonment, or the imposition of both a fine and <br />imprisonment. <br />SECTION 2. Chapter 15, article 1, section 15 -7, of the Hawaii County Code 1983 <br />(2005 Edition), is amended to read as follows: <br />"Section 15 -7. Penalty. <br />Any person convicted of violating any provision contained in this chapter shall be <br />punished by a fine not exceeding $1,000 or by imprisonment not to exceed [ninety] thirty days, <br />or both, and shall be adjudged to pay all costs of the proceedings. In addition to the penalties <br />provided herein, the County may recover for damages to its property, the measure of which shall <br />be the cost of repairing, replacing, or rebuilding the property injured or destroyed." <br />SECTION 3. Material to be repealed is stricken and bracketed. New material is <br />underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need <br />not be included. <br />
