COUNTY OF HAWAII <br />STATE OF HAWAII <br />ORDINANCE NO. X12 r79 BILL NO. 59 <br />AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAI'I COUNTY CODE 1983 <br />(2005 EDITION), RELATING TO VEHICLES AND TRAFFIC. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI'L <br />SECTION 1. Chapter 24, Article 1, Section 24 -3, of the Hawai'i County Code, 1983 <br />(2005 Edition), is amended to add the following, to be appropriately numbered and to read as <br />follows: <br />O "Speed Limit" means the absolute maximum speed limit <br />designated and physically displayed in the right of way for <br />establishing the legal maximum vehicle velocity. <br />SECTION 2. Chapter 24, Article 7, Division 2, of the Hawaii County Code 1983 (2005 <br />Edition) is amended to add the following new section to be appropriately numbered and to <br />read as follows: <br />Section 244 ). Maximum speed limits may be reduced in a <br />residential or a business district <br />(a) The Director of public works is authorized to approve the <br />reduction of maximum speed limits in residential and <br />business districts in five mile per hour increments to a <br />minimum of 15 miles per hour for any subdivision being <br />developed under Chapter 23 of the Hawaii County Code. <br />The Director may reduce speed limits under this section <br />when topographical, geometric and /or physical conditions result <br />in limited sight- distances, vehicle operating restrictions and /or <br />other engineering safety factors that warrant such a reduction. <br />(b) Speed limits set by the Director of public works pursuant <br />to this section may be further changed by the council by <br />ordinance. <br />SECTION 3. Material to be repealed is bracketed. New material is underscored. In <br />printing this ordinance, the brackets, bracketed material and underscoring need not be included. <br />
