COUNTY OF HAWAII ORDINANCE NO. G STATE OF HAWAII BILL NO. 80 1-�S (Draft 3) AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 14 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION) AS AMENDED, BY ADDING A NEW SECTION RELATING TO AUTHORITY OF THE MASS TRANSIT AGENCY. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 2, Article 14, Hawai'i County Code 1983 (2005 Edition) is amended to add a new section to be appropriately numbered and to read as follows: "Section 2- . Authority to adopt rules and regulations The agency is authorized to adopt reasonable rules and regulations as the agency deems necessary for the administration of the conduct of the agency's business, including rules and regulations for fees and charges for permits for interior advertisements on buses. Rules shall be promulgated pursuant to Chapter 91, Hawai'i Revised Statutes, as amended." SECTION 2. If any provision of this ordinance or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. This ordinance shall take effect upon its approval.
