MR. MIDDLESWORTH: Exactly. <br />MR. KANUHA: I'm sorry to interrupt, but the motion has been withdrawn by Commissioner <br />Melrose. Personally I feel that the original Plan _39 as corrected, or Plan_40, should be taken out <br />to be made available at the public hearings as well. <br />MS. POINDEXTER: I would say that after hearing from her earlier, it wasn't just one person. It <br />was a community effort and I think this community came out very strong throughout the process <br />and I agree with Bo that we should keep this one. It looks pretty good to me on one side of the <br />island and we can work on the other side. <br />Mr. Kahui moved to keep Plan _40, and <br />to make Plan _40 available for public hearings. <br />Seconded by Ms. Poindexter and carried by <br />the following vote: <br />Ayes: Commissioners Kahawaiola`a, Kahui, <br />Kanuha, Melrose, Middlesworth, <br />and Poindexter. <br />Noes: Commissioner Ugalde and Chair Siracusa.. <br />Absent: Commissioner Carvalho. <br />MR. KANUHA: The motion is approved to make Plan_40 available at the public hearings. <br />MR. MELROSE: As I remember, there was Plan _39 corrected, and we had to change it to make <br />it Plan _40. So we had to make a small tweak to do that. So we are going to take out what <br />Plan-40 was when we made the one small tweak. <br />MR. KAHAWAIOLA`A: Just for a point of personal privilege, Plan _39 was submitted was <br />submitted late, Plan-39 corrected was brought in; so am I correct in assuming Plan _3 9a was also <br />late, then tweaked by the Commission, then labeled Plan_40, which we will take out to the <br />public? <br />MR. MIDDLESWORTH: Right, that is correct. <br />MR. KANUHA: One clarification. Plan 39 was submitted in accordance with our rules. <br />Plan _39 corrected was what we were just talking about. We personally named that Plan_40, as a <br />commission. <br />MR. KAHAWAIOLA`A: I just wanted to make that clear. That was based on Mr. Udovic's <br />information to us, because it was submitted late. But the concept is what we would like to do. <br />just wanted to be very clear because I don't want somebody else to come by and say they <br />submitted something late and that wasn't considered. So. I just want to be sure that all our <br />language is clean and we don't get into any slippery slopes. I can't catch myself on a slippery <br />slope. <br />43 <br />
