<br />5. UNFINISHED BUSINESS <br /> <br />a. Petition No. 2011-09: Review draft order dismissing petition, which alleged a <br />violation of Section 2-83 (Fair Treatment) of the Code of Ethics by the Real <br />Property Tax Division of the County of Hawai‘i. <br /> <br />The Board reviewed the draft order. Ms. Schoen pointed out a typographical error on <br />page 2, on the seventh line in the first paragraph. The year of the document referenced was <br />supposed to be 2010. <br /> <br />Mr. Henricks pointed out an error in the last paragraph of page 2, where it stated that the <br />Board unanimously approved the motion to dismiss. He reminded the Board that the vote was <br />not unanimous, that Mr. Heaukulani voted against the motion, as reflected in the minutes. <br /> <br />Ms. Schoen asked Mr. Henricks if it would be permissible for her to strike the word <br />“unanimous,” and he said yes. <br /> <br />Motion and vote: Mr. Henricks moved to approve the order as amended with the two <br />corrections, Mr. Hisashima seconded the motion, and all members present voted aye. <br /> <br />Motion and vote: Mr. Henricks moved to go into executive session, Mr. Hisashima <br />seconded the motion, and all members present voted aye. Mr. Balsis clarified that the Board was <br />going into executive session specifically to review the confidential minutes and financial <br />disclosures agendized therein. <br /> <br />10:05 a.m.: The Board left regular session. <br /> <br /> <br />10:10 a.m.: The Board returned to regular session. <br /> <br /> <br />6. VOTING ON EXECUTIVE SESSION MATTERS <br /> <br /> <br />a. Approval of the executive session minutes of December 7, 2011. <br /> <br /> <br />Motion and vote: Mr. Henricks moved to approve the minutes, Mr. Hisashima seconded <br />the motion, and all members voted aye. <br /> <br />b. Review of Confidential Financial Disclosure Forms filed pursuant to Section <br />2-91.1(d), Hawai‘i County Code, by County board and commission members <br />and designated County employees, where personal matters will be reviewed. <br /> <br /> <br />Motion and vote: Mr. Henricks moved to approve all of the disclosures except that of <br />Mr. Balsis, since Mr. Balsis could not vote on his own disclosure and there would not be a <br /> <br /> <br />
