GIFFIN: Any other comments? Commissioner -. <br /> <br />HICKCOX: I have a, I have a question in reference to, well, actually to Ivan for one. The approval <br />of this permit, does it eliminate liability issues totally for the County, as far as the approval of this <br />permit is concerned? Because it seems to be that we are the starting gate for approval, and <br />henceforth it will be like a domino effect, if, you know, we continue to go down the line. <br /> <br />TORIGOE: Madam Chair? <br /> <br />GIFFIN: Mr. Torigoe. <br /> <br />TORIGOE: Yeah, this kind of a question, to really discuss fully, should be done in executive <br />session because it involves potential liabilities of County. Generally speaking, the Planning <br />Commission acting as a quasi-judicial body and making decisions like this would be immune unless <br />you do something that is just really, you know, obviously and almost intentionally wrongful. I think <br />in any case, you should pay sufficient attention to this issue of, you know, liquor being served in a <br />place that is accessed by the Saddle Road. I think it’s been discussed enough on the record already, <br />so it’s a known issue to you. And possibly, also, I’m not sure the extent to which the Liquor <br />Department would take into account the roadway as part of the setting, but that may be something <br />that you want to make sure is done when an application is made to the Liquor Department. <br /> <br />HICKCOX: And I have, I have another question. <br /> <br />GIFFIN: Yes, Commissioner. <br /> <br />HICKCOX: One is to our Director. In that there is a lot of what-if’s in this particular proposal, <br />would it be within our purview, should we recommend the approval, to limit it to maybe two years <br />and then reapply after the event itself has either proven or disproved in its success and/or failure? <br /> <br />GIFFIN: Director. <br /> <br />LEITHEAD TODD: I think on that one, I’d want to hear from the applicant whether or not that’s <br />an issue for them. <br /> <br />GIFFIN: Bill? <br /> <br />MOORE: Just, before he gets into that, I just want to cover again with respect to the alcohol. <br />Again, I believe that there’s a number of safeguards that are built in to this. One is the liquor <br />license that is required; you have to go and prove all of that, the liability issues. But it’s also the <br />security plan that we have to get approval of the Planning Director. If special duty police are <br />incredibly important part of the security plan and they are not available because of the alcohol <br />serving, well, that’s going to be a limiting factor. So I think there are built-in safeguards along the <br />way in terms of, you know, how you perceive alcohol and the like. And again, starting off crawling <br />and walking before you run is important. But, you know, it’s one that Tim doesn’t have permission <br />to run alone; he has to get permission from a number of people along the way, coordinate with the <br />police, coordinate with the Liquor Commission, getting approval from the Planning Director. So I <br />believe that there’s a number of safeguards built in to this condition. And then, with respect to the <br />second one -. Why don’t you go ahead, Tim, then we can -.
