WHITTEMORE: Well, no, in answer to my question, has the board talked to the Takamines? And
<br />it sounds as though they have not.

<br />MCANIFF: We have not.

<br />GIFFIN: Any other questions? I don’t know who I should address this question to, but it seems
<br />that when Mr. Gonzalez testified, he spoke of the possibility, and I think, if I understood you
<br />correctly, in the past that either leaving the event people would congregate on the side of the Saddle
<br />Road and drink, use illegal drugs, were a menace on the highway. Am I communicating the correct
<br />sense of what you said?

<br />GONZALEZ: Yes, that was -.
<br />
<br />GIFFIN: Okay, at what point – I guess maybe I’m asking corp. counsel – does the applicant cease
<br />to have any responsibility, and when does the Police Department, when do they come in and do
<br />their job?
<br />
<br />TORIGOE: Well, I think your permit basically covers what’s going on onsite, right, and the
<br />applicant presumably would not have any police power offsite. So in a sense -. In fact, the Director
<br />has something to add to that.
<br />
<br />LEITHEAD TODD: If you are going to have, I think, was it eight, special duty police officers who
<br />will be in uniform as part of the security plan, I think that is significantly different from the prior
<br />festivals, which did not have uniform police officers. And I think that alone will be a deterrent from
<br />people congregating in that immediate area, because special duty police officers, even if they are
<br />hired for the event, if they see something like that occurring, they have the authority to go over and
<br />arrest people for doing stuff like, you know, if it looks like they are going to go and be a -. They
<br />can test them for DUI, if they see something like that. And I assume the police officers would, and
<br />it would be, because they are basically kind of on-call 24 hours a day, if they saw something like
<br />that. But, you know, hey, could you assume that people a mile away we are going to stop -. I mean
<br />I don’t know that you can go through the whole parade of horribles that could possibly occur under
<br />people’s bad behavior. I think all you can do is evaluate the application, evaluate whether the
<br />security plan is -. We are proposing language that says I have duty to investigate any complaints
<br />about it, and I have the authority to suspend the special use permit and to seek revocation of the
<br />permit. But I also would assume that the homeowners’ association, because it’s only with their
<br />consent that this event can take place, would have similar ability to revoke the ability of Mr.
<br />Bostock to hold the event, if there was an impact on the community up there. And if the residents
<br />who live there found that the way it was run was objectionable, they would, they, you know, would
<br />bring their concerns to the board and the board could act. I mean, so I think that there are those
<br />safeguards. But ultimately this is the Commission’s decision in terms of whether you want to
<br />proceed on this. And beyond us, it will ultimately actually be the homeowners’ association who is
<br />the most directly impacted and who has the most direct ability to determine whether there is an
<br />impact on the immediate community. And I assume that I will get calls complaining, if something
<br />goes wrong.
