Ivan Torigoe. <br /> <br />TORIGOE: Yeah, no, I just, listening to language that’s proposed – it’s kind of hard to really parse <br />it without having it clearly before us – but I’m wondering if it might be wise to just make it explicit <br />that it’s where the seawall establishes the shoreline at present or as it shall change in the future, you <br />know, or if it changes in the future or something like that, when -. <br /> <br />VITOUSEK: I don’t see why that’s necessary because what it says -. The shoreline is, the <br />shoreline is not something that’s fixed in a point of time – shoreline by definition. I think it says the <br />certified shoreline. <br /> <br />LEITHEAD TODD: Well, I was getting rid of the word “certified” and just saying “shoreline.” <br /> <br />VITOUSEK: That’s a defined term. <br /> <br />LEITHEAD TODD: Yeah, cause it’s a defined term, I didn’t think you need any -. <br /> <br />VITOUSEK: As a certified shoreline. <br /> <br />LEITHEAD TODD: Uh huh. <br /> <br />VITOUSEK: But that’s okay. <br /> <br />GIFFIN: Okay. <br /> <br />VITOUSEK: I just don’t think it needs anything, the shoreline, yeah. <br /> <br />GIFFIN: You are comfortable with that? <br /> <br />VITOUSEK: Well, I just don’t think it’s necessary. I would prefer to have it the way it was -. <br /> <br />GIFFIN: Sure. <br /> <br />VITOUSEK: Before. <br /> <br />TORIGOE: Yeah, and I would defer to the Planning Director. I just threw that out. <br /> <br />LEITHEAD TODD: Yeah, I’m comfortable that the discussion that we have here in the record <br />establishes the intent that, hey, if ten years from now, the shoreline has moved in and it’s running <br />along the wall, then we are talking about six feet along the wall. And as other people in this area <br />come in and need any permits from the Planning Department, we are going to be seeking similar <br />requirements on everybody that’s got a wall in Puakō, because if the walls end up defining the <br />shoreline and there is no public access, we are going to -. <br /> <br />GIFFIN: Yeah, we are in trouble. <br />16 <br />EXHIBIT B <br /> <br />
