KERN: With that said, I am going to call up six people at a time. And some of you might not be <br />testifying any more who are on this list. So Daniel H. Cunningham, Jon Olson, Sativa Jones, R. J. <br />Hampton, James MacRae, and Dominic Yagong. And I will also apologize in advance for messing up <br />anybody's name, particularly their last name. I apologize. Okay, so we have one, two, three -. Okay, <br />so we got, sorry, Daniel, we have Jon Olson, just a minute, I’m just making sure we have -. And <br />Dominic Yagong is -? <br /> <br />PUBLIC: Out to lunch. <br /> <br />KERN: Okay. So we’ll call up Robert Kort, Kortokray -. <br /> <br />KORTOKRAX: Kortokrax. <br /> <br />KERN: Kortokrax, sorry. All right. So I’m going to swear you all in. And if you’re, you’re going to <br />be speaking as well, could you please raise your right hand as well, all, you all. Do you swear to tell <br />the truth today before the Windward Planning Commission? <br /> <br />TESTIFIERS: I do. <br /> <br />KERN: Okay, very good. We'll be doing three minutes as well, and we have the cards there. And at <br />which time the three minutes is up, I will cut you off swiftly, equally amongst everybody. And it is no, <br />nothing personal, just the way that it is. So –. What we'll do is, start with giving your name and area <br />in which you live and then you may begin. So we will start with Daniel. <br /> <br />CUNNINGHAM: Daniel I live in Volcano and I am a visitor of the Denissens (phonetic) of Sea View <br />and the wonderful environment that I have been so fortunate to share with these beautiful people. <br />There was a time before administrative agencies when any controversy was resolved by a jury and <br />there would be two sides. I think you, there seems to be a consensus that it's a very one-sided issue. <br />There's a lady yelled something and ran out the door, and there are a few anonymous complaints. But <br />you good people are behest with the burden as an administrative agency to “uphold the law” and how it <br />works. But the fact of the matter is that it has become too litigious and complicated for diversified <br />complex cinching human beings as we are to, to meet all of the demands and the requirements of an <br />administrative agency unless you have, are backed by an oil conglomerate with lots of money to pay <br />lawyers so that all those innuendos and small issues that people need to try to do could be resolved. <br />We are not the strong. We are the weak. These are all local people who live here. Their hearts are the <br />reason why they came, because they are good people. And I am very grateful to have such an <br />opportunity to speak here today with all of you. <br /> <br />And I sense that I think the people on the Board want to do the right thing also. It is nice to be <br />important, but it is more important to be nice. And if we don't be nice we won't have a nice place for <br />our children. And if our children grow up in an archaic society that is designed by an administrative <br />agency and we had no jury system, communists and fascist regimes are similar in the sense that they <br />are ruled by an administrative agency.
