As a result of continuing to operate the farmers market and other SPACE related events on SPACE <br />property, and continued advertising of these events, the Planning Director initiated revocation <br />proceedings before the Planning Commission. Again, this was in direct response to Condition H <br />which was a requirement to the Planning Department. <br /> <br />As a result of continued non-compliance with conditions of the Special Permit and non-compliance of <br />the three Cease and Desist Orders, it is recommended that this Special Permit be revoked. <br /> <br />Thank you. <br /> <br />KERN: Thank you, Jeff. Thank you for your detailed presentation. Any questions for staff? Seeing <br />none, thank you very much. Okay. So I’m going to talk briefly just about what the options are here <br />today. There are basically three options. One option is that the permit is revoked. The other option is <br />that the permit is not revoked and the original permit remains, and they’re to become compliant with <br />all that. The third option is that it gets continued to a specified date and the app -, the permit holder <br />could come in with an amendment to their existing special use permit which would then kind of <br />mitigate the revocation. And it would kind of come under one umbrella with getting compliant with an <br />amended permit. So those are the three options that we have – revoke, not revoke, or continue with the <br />agreement that an amendment would be coming forth. Any questions from my Fellow Commissioners <br />regarding that? Commissioner Au? <br /> <br />AU: Is there an amendment that was submitted? <br /> <br />KERN: Not at this time. There is no amendment. Any other questions? Oh, Jeff. <br /> <br />DARROW: Thank you, Commissioner Au, for bringing that to my attention. We have had, since the <br />background and recommendation report was submitted to the Planning Commission, there has been <br />numerous letters that have been received by the Planning Department. Quite a number of letters of <br />support, as well as several letters of opposition. The Planning Commission has received those. <br /> <br />Additionally, this morning we’ve received a correspondence from the Applicant’s representative, <br />Attorney Ted Hong, two correspondence. One is this larger document, as well as a smaller document <br />in regards to today’s proceedings. Thank you. <br /> <br />KERN: Thank you. Yes, so we do have the stack of letters here that are in the manila envelope, and <br />then the other correspondence from their representative. What this is not about, this is not the venue or <br />forum to change laws. This is not the forum to really get into that. This is really specific to the <br />revocation of this permit, whether to do it or not to do it or continue it. So I’d like to keep testimony <br />on that as well. When that time comes then I’ll talk about that a little bit more, right before public <br />testimony. So that’s basically where we’re at right now. And with that we’ll go to the Applicant of the <br />permit holder, and give me your name and area you represent. Oh, first, let me swear you in.
