Notes from Growth Management Subcommittee Meeting August 6, 2012 <br />Attendees: Jim Pedersen, Hermann Fernandez, and Margaret Willie <br />We tabled the review of the latest draft of the “Procedures and Policies of the <br />Growth Management Subcommittee” until the NKCDP AC makes some decisions <br />regarding notification of the community by email. <br />Kohala Wishing Well, LLC withdrew their Special Permit Application for a school <br />at the end of Hoea Road. <br />The subcommittee reviewed the Plan Approval of Jack Hoyt’s townhouse <br />building in Kapaau. We understand that we have no ability to influence the plan <br />approval application, but the subcommittee had several questions about what <br />procedures and applications Jack Hoyt needed to obtain, before he received plan <br />approval. Mainly, we wanted to know if this subcommittee, through the Land Use <br />Permit report, received any prior notice that this proposed townhouse was under <br />review by the Planning Dept. <br />The subcommittee reviewed Sennett’s subdivision application and site plan. We <br />had no comment regarding the subdividing of a 50-acre parcel into two parcels <br />(29.471 acres and 20.676 acres) that still conform to the underlying zoning AG- <br />20A, and, eventually, obtaining a water variance for the parcel without a meter. <br />The subcommittee reviewed the tentative approval with conditions of Lot 40 <br />Kohala Estates, LLC and Lot 41 LLC. The subdivision was approved and the <br />developer will need to provide access to lot 40-A (the flag lot) that meets the <br />standards of the Dept of Public Works. The former road lot (Lot 41) will become <br />an easement and must be in favor of those other lots within Kohala Estates with <br />existing legal rights over extinguished Lot 41. <br />Finally the subcommittee has two recommendations: <br />1) We think it a good idea, if the Planning Dept. Reviewer took a closer look at <br />subdivision applications to make sure the applicant is in “full” compliance with the <br />County’s rules and regulations, before the County permits a profitable windfall to <br />the applicant. For example, confirming that structures shown or discussed in the <br />application file are properly shown and identified, including any building permit <br />numbers, on the site plan. <br />2) We highly recommend that all new applications to the Planning Dept. have a <br />hard copy file and a digital copy file. This will create redundancy in the system in <br />case of misplacement, fire, or theft, and this will allow the public/CDP easier <br />access to, what are fundamentally, public records. We think this is the future, it <br />is more open and transparent, and will be much more efficient than our current <br />system.
