Hawaii Police Commission <br />Regular Session Minutes <br />September 14, 2012 <br />Page 6 <br />EXECUTIVE SESSION <br />Commissioner Victorine moved to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawai'i Police Department, to consider <br />sensitive matters relating to public safety, to conduct a mid -year evaluation of the Police <br />Chief, and to consult with Corporation Counsel on questions and issues pertaining to <br />the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS <br />92 -5 (a) (2) (4) (6) and the Hawai'i County Charter Section 13 -20 (b). Commissioner <br />Schutte seconded the motion, and it carried unanimously. Executive session convened <br />at 10:31 a.m. <br />Regular session reconvened at 12:12 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• HPC 12 -13: Complainant's wallet was stolen. She alleged that an officer let the <br />suspect go, and there was lack of response from the officer. Commissioner Schutte <br />moved that there was insufficient evidence to prove the complainant's allegation of <br />misconduct. Commissioner Horner seconded the motion, and it carried <br />unanimously. <br />HPC 12 -14: Complainant alleged that an officer took her to the hospital against her <br />will. Commissioner Horner moved that there was insufficient evidence to prove the <br />complainant's allegation of misconduct. Commissioner Schutte seconded the <br />motion, and it carried unanimously. <br />HPC 12 -24A and 12 -24113: Complainant alleged that an unidentified officer <br />mistreated him while he was at the police station. Commissioner Schutte moved to <br />refer the complaint to the Chief for an investigation by the Office of Professional <br />Standards. Commissioner Victorine seconded the motion, and it carried <br />unanimously. <br />• HPC 12 -25: Complainant complained about the manner in which two police vehicles <br />were driven. Commissioner Victorine moved to refer the complaint to the Chief for <br />an investigation by the Office of Professional Standards. Commissioner Schutte <br />seconded the motion, and it carried unanimously. <br />• HPC 12 -27: Complainant alleged that an officer's report was full of lies and slander. <br />Commissioner Schutte moved that there was insufficient evidence to prove the <br />complainant's allegation of misconduct. Commissioner Kualii seconded the motion, <br />and it carried unanimously. <br />• HPC 12 -28: Complainant alleged that about twelve years ago, an officer arrested <br />him in error. He also alleged that about twelve years ago another officer did not <br />honor his sovereign rights. Commissioner Victorine moved to decline further <br />investigation of the complaint due to the 90 -day rule. Commissioner Schutte <br />seconded the motion, and it carried unanimously. <br />
