TORIGOE: Mr. Vitousek, I just want to ask you. You mentioned that there was a Kohanaiki <br />related case that you argued before the Supreme Court. Did that result in a published opinion? <br /> <br />VITOUSEK: Public Access Shoreline Hawai‘i versus Hawai‘i County Planning Commission. <br /> <br />TORIGOE: Okay, I just wanted to find out which one that was. So it’s the Public Access Shoreline <br />Hawai‘i case. Okay, thank you. <br /> <br />GIFFIN: Okay. Any other questions? Commissioners, I would feel very comfortable, if we could <br />have some sort of, not some sort of, if we could have executive session with our legal counsel. So if <br />one of you would be comfortable in suggesting on the record, I would really appreciate that. <br /> <br />NELSON: So move. <br /> <br />GIFFIN: Do I hear a second? <br /> <br />BEAUDET: Second. <br /> <br />GIFFIN: All those in favor of going into executive session, please say aye. <br /> <br />COMMISSIONERS: Aye. <br /> <br />GIFFIN: Anyone opposed? Thank you. <br /> <br />EXECUTIVE SESSION The Commission went into executive session at 11:55 a.m. and came <br />out of executive session at 12:35 p.m. by a motion made by Commissioner Iokepa, seconded by <br />Commissioner Nelson, and unanimously carried by a voice vote of all Commissioners in <br />attendance. <br /> <br />GIFFIN: The meeting will come back to order. It is after much discussion that the Commission <br />would like to continue this discussion until our next meeting for more information on the details of <br />the intersection of the current design and of the proposed future design. In addition, we hope that <br />this, we would like this time to allow Public Works to review and respond to the concerns of the <br />applicant for standing. We would like all of this information that would come from this kind of <br />time, and hopefully discussion, to be forthcoming by ten working days prior to our next meeting. <br /> <br />VITOUSEK: May I address the Commission for just a minute? <br /> <br />GIFFIN: Hang on. <br /> <br />VITOUSEK: Oh, I’m sorry. <br /> <br />GIFFIN: Commissioners, I wanted to turn to you and find out from you if that was what we all <br />believed in and what we agreed to, and if there was anything else you individually wanted to add. <br /> <br />IOKEPA: Madam Chair -. <br /> <br />22 <br />EXHIBIT B <br /> <br />
