(1) The specific points of procedure, fact, law, or policy to which exceptions <br /> were taken. <br /> (2) The facts and reasons why report and recommendations must be affirmed. <br /> 4-4 Oral Argument before the Commission. <br /> (a) Party's Request. If a party desires to argue orally before the Commission, a written <br /> request with reasons therefor shall accompany the exceptions or the support brief or <br /> statement filed, and the Commission may grant such request. <br /> (b) Commission Direction. The Commission may direct oral argument on its own <br /> motion. <br /> 4-5 Commission Action. <br /> (a) No Exceptions Filed. In the event no statement of exceptions is filed with the <br /> Commission,the Commission may proceed to reverse,modify, or adopt the <br /> recommendations of the hearing officer. <br /> (b) Exceptions and Support Statements Filed. Upon the filing of the exceptions and <br /> briefs or statements,the Commission may render its decision forthwith upon the <br /> record; or if oral argument has been allowed, after oral argument; or may reopen the <br /> docket and take further evidence or may make such other disposition of the case that <br /> is necessary under the circumstances. <br /> PART 5. RULEMAKING PROCEDURES <br /> 5-1 Initiation of Rulemaking Proceedings. <br /> (a) Motion by Commission. The Commission may, at any time on its own motion, <br /> initiate proceedings for the adoption,amendment, or repeal of any rule of the <br /> Commission. Procedures to be followed in rulemaking shall be as set forth in these <br /> rules and the applicable statutes. <br /> (b) Petition by Person or Agency. Any interested person or agency may petition the <br /> Commission for the adoption, amendment, or repeal of any rule of the Commission. <br /> Petitions for rulemaking filed with the Commission will become matters of public <br /> record. <br /> (c) Form and Content. Petitions for rulemaking shall conform to the requirements of <br /> section 2-4 of these rules and shall contain: <br /> (1) The name, address, and telephone number of each petitioner and the <br /> signature of each petitioner; <br /> (2) A draft or the substance of the proposed rule or amendment or a designation <br /> of the provisions,the repeal of which is desired; <br /> (3) A statement of the petitioner's interest in the subject matter; and <br /> (4) A statement of the reasons in support of the proposed rule, amendment, or <br /> repeal. <br /> 7-17 <br />
