CASE NO. 2012-15 (10:00 A.M.) – Continued from September 20, 2012, November 15, 2012, December 5, 2012, January 24, 2013, April 18, 2013 In the Matter of the Accusation Against EA Restaurants, LLP, dba Eddie Aikau Restaurant and Surf Museum, located at Waikoloa, Hawai‘i. COUNT I Formal Hearing (Alternative III) on violation of Section 281-78(b)(1)(B), of the Hawai‘i Revised Statutes, as amended, service and consumption of intoxicating liquor to an individual while under the influence of liquor. COUNT II Formal Hearing (Alternative III) on violation of Rule 3-1-F-1 of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawai‘i, State of Hawai‘i, consumption of liquor by an individual outside of the permitted consumption area of the licensed premises. COUNT III Informal Hearing (Alternative IV) on violation of Rule 5-3 of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawai‘i, State of Hawai‘i, failure to have its annual listing of employees with liquor cards (Manager’s list) posted within the licensed premises readily available for inspection. COUNT IV Formal Hearing (Alternative III) on violation of Rule 5-2 of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawai‘i, State of Hawai‘i, failure to have a person duly approved by the Department as a person in active charge of the premises at all times while the premises was open for business.
