I reside in Hilo. <br /> <br />AU: Okay, has our Planning Director’s position changed on this application? <br /> <br />LEITHEAD TODD: No, it has not. <br /> <br />AU: Okay. Do you guys have any comments on what the applicant is saying or any procedures <br />as we move forward? <br /> <br />SELF: The way the Planning Director is viewing the process is that if it’s going to go to <br />contested case hearing then, of course, notice has to go out to the neighbors within the <br />surrounding properties to give them an opportunity to intervene, because I don’t believe that has <br />been addressed. I don’t think they’ve been given an opportunity to intervene. <br /> <br />TORIGOE: Mr. Chairman? <br /> <br />AU: Go ahead, Ivan. <br /> <br />TORIGOE: Yeah, staff indicates that Planning Department did notify everyone who was on the <br />original list of people within the necessary permit, radius distance from the property, as well as <br />additional people. Everyone was given, you know, notice of today’s meeting that included the <br />opportunity for intervention. And this was mailed February 15, 2013. <br /> <br />SELF: But the decision for a contested case hasn’t even been made yet. So we don’t, how were <br />they notified since the decision hasn’t even been made as to whether or not -? Is today the <br />contested case hearing or -? <br /> <br />TORIGOE: Well, I understand that the notice, they basically informed people that they had the <br />right to file for a contested case and included the usual form. Maybe staff can confirm that. <br /> <br />SELF: Well, you know, they would be intervenors, yes, okay. They would be -. <br /> <br />AU: Mr. Arai? <br /> <br />ARAI: Because of the concerns, regarding procedural concerns that were raised, as part of our <br />normal notification to surrounding property owners regarding the upcoming, today’s meeting, we <br />included in that notice an opportunity for everyone, for the public to file for intervention in a <br />contested case proceeding. Along with that notice was the actual petition that was included in <br />the meeting notice. So as part of advertising today’s meeting, we did include the opportunity for <br />th <br />intervention; and that letter was mailed out of the Planning Department on February 15. <br /> <br />9 <br /> <br /> <br />
