22. Service of Decisions and Orders <br /> <br />Decisions and orders shall be served by mailing copies to the <br />parties of record. When service is not accomplished by mail, it may <br />be affected by personal delivery of a copy or electronic delivery <br />through email or similar method. When a party to a proceeding has <br />appeared by a representative or counsel, service upon such <br />representative or counsel shall be deemed to be service upon the <br />party. <br /> <br />23. Reconsideration of Decision or Order <br /> <br />The hearing officer shall not reconsider the decision in any <br />contested case hearing after the effective date of the decision. <br /> <br />24. Appeal from the H <br /> <br />decision in the manner set forth in Section 91- <br />Statutes. <br /> <br />25. Modifications, Stipulations <br /> <br />Any of the foregoing procedures may be modified or waived by <br />stipulation of the parties and informal disposition may be made of <br />any contested case by stipulation, agreed settlement, consent order <br />or default. <br /> <br />Section 8 Administrative Authority for Fee Structure <br /> <br /> <br />A. The Director uly designated representative may require <br />the lessee to post a supplementary cash deposit equal to the estimated <br />cost that may be accrued by the County by allowing the scheduled event. <br />Such cash deposit may be defaulted for failure to restore the facility to its <br />pre-use condition; for cancellation of an event within twenty-one (21) days <br />prior to the event; and (OR) for damages incurred to the facilities during <br />the period of occupancy by the lessee. Additional deposit for equipment <br />may also be required up to fifty (50) percent of equipment replacement <br />cost. <br /> <br />B. Temporary structures requiring a permit shall be assessed a flat fee of ten <br />dollars ($10) per permit. <br /> <br />C. All lessees of Department facilities are responsible for ensuring their use <br />complies with the current Americans with Disabilities Act. <br /> <br /> <br />17 <br /> <br /> <br />
