At this time I’m going to open up for some <br />discussion here. I do have a comment to make. I did look at the letter and I did look at the Code <br />and I do see that all the shields are there. Technically I can see that you’ve taken appropriate <br />steps with Mr. Maeda taking control of the situation in order to avoid a conflict of interest. <br />However, I think it’s important to point out that you have, what you may have is a technical <br />conflict of interest. The perception in the community may be different and I don’t know if there’s <br />any shields you can put up in terms of community perception and I just say that from a word of <br />advice. You’re asking for advice or thoughts from us, that’s my thought. <br /> <br />Mr. Henricks: I think as to your statement on perception I think that by coming forth in <br />front of us, is what you’re trying to do is take care of the fact that if we approve it, it’s on our <br />back, not on your back, so I think that would take care of the perception of the community, okay. <br />Is that the way you see it? <br /> <br />Mr. Adams: I’m a little less sanguine about the situation. I do see 2-83b and if we <br />reach, it could fall under us. I’m a little, part of our responsibility here as a Board, and mine as a <br />Board Member, is to take a look and we’re going to talk about this later, and we’ve talked about <br />it already, is take a look at this Code and the interpretation of the Code, not anything that’s <br />outside the Code. If I take a look at what you’ve asked us to look at here in terms of your <br />position now and your desire to run for office while you maintain your position, that, although I <br />can see that there may be conflicts perceived or real as a part of that I still question whether or <br />not this Code actually addresses that for you. It may be addressed in other areas, it’s because it’s <br />not addressed here because these Ethics Codes, at least in my mind, are focused primarily, not <br />completely, but primarily on financial interests, that’s where we see the questions about conflict <br />of interest. I don’t see that necessarily as what you’re concerned about. There are candidacy <br />issues that are covered here as well and so we can go to that level. I guess I would be concerned <br />that there is more than a perception here and that although we can set in place a variety of walls <br />10 <br /> <br /> <br />
