There is a <br />Notice of Violation and Order attached to the petition as well as an Investigation and Report <br />Form. So, has the Notice of Violation and Order been dealt with within the Department? <br /> <br />Mr. Northrop: Repeatedly. <br /> <br />Ms. Schoen: Okay and then the investigation, it appears as though an investigation was <br />conducted, has that been completed? <br /> <br />Mr. Northrop: That has. <br /> <br />Mr. Balsis: So the issue here is not whether or not Mr. Pickens is in violation of any <br />ordinances. The issue is the conduct of… <br /> <br />Mr. Northrop: My ethics. <br /> <br />Mr. Balsis: Yes, that would be under Section 2-83(a)(3), so we’re looking under fair <br />treatment. <br /> <br />Mr. Henricks: It says fair, impartial and courteous treatment. That’s what it says. <br /> <br />Mr. Balsis: So that’s what we’re looking at here. Those issues are County permitting, <br />flood issues, FEMA and all of that stuff. <br /> <br />Ms. Schoen: So we will provide a letter to the parties informing them of the date and <br />time of the next hearing. <br /> <br />Mr. Balsis: Yes.
