116 <br />party in the hearing; or <br />(3) has participated in any investigation preceding the <br />institution of the hearing or in a determination that should be <br />instituted or in the development of the evidence to be <br />introduced therein. <br />[Eff. 09/28/02; am ] (Auth: HRS § § 76-47, 91-2) ( Imp: HRS § § 76-47, 91-2) <br />§ 104-10 Record of hearing. <br />(a) A record of the hearing shall be compiled in accordance with <br />Hawai'i Revised Statutes, subsection (e) of §91-9. <br />(b) Minutes of the hearing shall be kept and an audio recording of the <br />hearing made. Transcription of the hearing shall be made only as <br />provided in Hawai'i Revised Statutes, subsection (f) of §91-9. <br />[Eff. 09/28/02] (Auth: HRS §§76-47, 91-2) ( Imp: HRS §§76-47, 91-2, 91-9) <br />§ 104-11 Subpoenas. <br />(a) Application for subpoenas requiring the attendance of witnesses or <br />the production of documentary evidence from any place within <br />the State of Hawai'i at any designated place or hearing shall be <br />made in writing to the Board or hearing officer. The application <br />shall: <br />(1) specify the name of the witness, or the specific documents <br />or data desired, and their relevancy to the issues involved; <br />(2) be made no later than ten days prior to the hearing; and, <br />(3) be accompanied by a prepared subpoena. <br />(b) If an application is not made within ten days of the hearing, the <br />Board may issue the subpoena and/or continue the hearing or any <br />part thereof. <br />(c) Once approved by the Board or hearing officer, the party <br />requesting the subpoenas shall be responsible for serving the <br />subpoenas upon the persons identified in the subpoenas. <br />(d) Enforcement of the subpoenas issued and served shall be written <br />application of any Board member to a circuit court judge. <br />[Eff. 09/28/02; am ] (Auth: HRS §§76-47, 91-2) (Imp: HRS §§76-47, 91-2) <br />
