Ms. Byrne-Baber, as I understand it is no longer a County official and therefore, <br />does not fall under the jurisdiction of this Board, and so if you’re looking for motions, I would <br />move that we would remove Ms. Byrne-Baber from consideration in this petition. <br /> <br />Mr. Henricks: I second the motion. <br /> <br />Mr. Balsis: There has been a move and it’s been seconded to remove Ms. Baber from this <br />petition because she’s not longer employed with the County as an official. Is there any <br />discussion on this? <br /> <br />Ms. Kahakalau: I just have a question if there is any kind of policy in place that, you know, <br />past violations, if there was a violation that they automatically are not considered when the <br />person is no longer an employee. I don’t know the Code of Ethics to that accustom. <br /> <br />Mr. Balsis: Counsel. <br /> <br />Ms. Kahakalau: Sorry. <br /> <br />Ms. Schoen: That’s correct. There is a state law which provides that if an officer or employee <br />is no longer employed then the Ethics Commission has no jurisdiction or authority to prosecute, <br />charge and proceed with the case. <br /> <br />Ms. Kahakalau: Thank you. <br /> <br />Mr. Balsis: Just out of curiosity. Does someone have another avenue through the legal <br />system? <br /> <br />Ms. Schoen: I’m not sure. Certainly you’d have to look at it on a case by case basis to see <br />whether or not there are other remedies. <br /> <br />Mr. Balsis: Okay. <br /> <br />Mr. McNett: Mr. Chair, if I just may quickly say that I’m aware of plenty of other avenues so <br />thank you for your concern. <br /> <br />Mr. Balsis: Well, there’s been a move and second to remove Ms. Baber, did I pronounce that <br />correctly from the petition.
