TITA: cease and desist— <br /> <br />HENKEL: Excuse me, you know, we want to act on this either for you or against you— <br /> <br />TITA: Yes. <br /> <br />HENKEL: --but any action has been delayed since last January, and I tell you that I’m greatly <br />fearing that you guys are going sit there and say the same thing over and over until next January, <br />so could you please wrap it up? You’re repeating yourselves. Excuse me. <br /> <br />TITA: I see your distain for me so we are finished. <br /> <br />HENKEL: It’s been a long day. <br /> <br />MIYASATO: Yeah, go ahead, Corporation—go ahead. <br /> <br />BRILHANTE: Thank you, Chair. William Brilhante again, Deputy Corporation Counsel on <br />behalf of the Planning Director in this matter. As we noted, Ms. Tita has raised legitimate <br />concerns regarding parking and safety issues that this Applicant needed to address and needed to <br />be vetted during the application process. Again, this is a process, and I think you know the <br />process has worked its way through in accordance to the requirements of both the Code as well <br />as the Planning Commission rules for a Special Permit. Specific items were identified in the <br />Planning Director’s Recommendation of approval. Specifically, Item No. 3 says that the <br />Applicant shall secure and finalize all Building Permits for all existing structures from the <br />Building Division, Department of Public Works, within one year from the effective date of this <br />amendment, proposed amendment. All parking for the community association, building, <br />emergency, shelter, and the farmers market shall be on the subject property. Parking shall be <br />prohibited on Road 8 or Road C for these uses. The Applicant shall provide traffic control <br />attendant (attendants) to actively manage traffic flow and parking associated with the farmers <br />market so that vehicles do not park or back up onto Road C and/or Road 8. The Applicant shall <br />provide signage indicating where vendors and visitors may park on site. Hours of operation for <br />the community center shall be from 9 a.m. to 9 p.m. daily. The farmers market shall be limited <br />to one day a week and shall limit the amount of vendors to 20. No amplification of music and <br />such and so forth. <br /> <br />So, I think the issues that are being raised by Ms. Tita here are being adequately addressed and <br />have been adequately vetted by the Planning Department through this process. And, the other <br />thing I wanted to just draw your attention to is that this is a Special Permit application, and the <br />current designation of the land is Agriculture. And HRS 205-2(d)(15) which was legislation <br />recently passed in 2012, specifically proposes that the Counties create Ag districts that shall <br />include Ag based commercial operations. And, one of the three specific Ag based commercial <br />operations is the operation of farmers markets, and I think farmers markets in a specific <br />community in a specific residence is very beneficial to sustainability, to reducing traffic use— <br />you know, the use of the residents to have to go to the grocery store, you know which would be <br />miles and miles away.
