Hawaii Game Management Advisory Commission Meeting <br /> Minutes —October 27, 2014 <br /> M. Bartell: I suggested it wasn't a priority and you said a few other things. So <br /> what in — I think one of the other commission members actually made the <br /> point that all these commissions are advisory, right? <br /> L. Hadway: Yes. <br /> M. Bartell: I would be very much in favor of making this game commission a <br /> rule making commission, right? <br /> L. Hadway: That's something an attorney general or a lawyer would have to <br /> consider and the statutes can allow. <br /> M. Bartell: Agreed. So let's just talk conceptually here. I mean there's lots of <br /> reasons to say no but conceptually, I would say that if we're gonna do a <br /> state game commission then let it make the rules. They seem to be a <br /> problem in terms of how fast they can get done, how they can get done, <br /> when they're revised. It just— if you've got a group that is focused on <br /> hunting and working with DLNR in a positive constructive way — it just <br /> seems to be that you should give them the rule making authority <br /> surrounding this. [Unclear] conceptually. I know there's probably lots of <br /> legal things but conceptually can you get on board with that. <br /> L. Hadway: I'm hesitant because I think of all the other commissions as well <br /> and given what the purpose of the Board of Land and Natural Resources <br /> is I think that it's the work of the commission is done well then that— <br /> everything's centralized at the Board of Land and Natural Resources level <br /> — it should be quite seamless in terms of staff and commission is working <br /> well together I can't image the board not supporting it. <br /> M. Bartell: How about you personally? <br /> L. Hadway: I think writing rules is an extremely challenging thing to do. I think it <br /> would be really difficult for a commission to actually write rules. You're <br /> gonna need the staff support there — you're gonna need the legal support <br /> there in terms of— one of the biggest issues that arose out of this last <br /> package was actually the American's with Disability Act and making sure <br /> the hunting rules were in compliance with that. And so I wouldn't expect <br /> that a commission would necessarily want or need the expertise to do that <br /> — but we would turn to the right resources to help us write those rules. <br /> M. Bartell: So I'm still trying to figure out what you Lisa Hadway stand on rule <br /> making versus advisory. <br /> L. Hadway: I would sit with advisory. <br /> 31 <br />
