KAY: So I apologize, one thing that was brought to my attention, the condition states that prior to <br />the designation of this management group the applicant shall solicit the input of the native Hawaiian <br />community and the County Council. So that brings in the possibility of scheduling and some other <br />kind of time constraints. So just kind of keep that in mind as you are determining what your <br />timeline might be. <br /> <br />BEAUDET: My suggestion is, you know, no longer than twelve months. Commissioners, any <br />discussion on that before we move forward? <br /> <br />SHIMAOKA: Yeah, I agree with the shorter time limit that we make sure that we ensure that the <br />things get cleared up first. That’s important to me. <br /> <br />KAY: If I may just suggest some language in terms of, in front of, before the starting of L, “Within <br />one year of the effective date of this amendment, the applicant shall identify an entity that would be <br />responsible for the management and care of the archaeological/cultural features …” and so on. <br /> <br />BEAUDET: I’m all right with it. <br /> <br />TYLER \[in audience\]: Is there a time limit for it being turned over? So that’s the other question <br />about the stewardship. <br /> <br />KAY: So the actual condition speaks to that: “Within 60 days of the identification of this entity, <br />this area, with the concurrence of the County Council, shall be conveyed via lease or fee to the <br />identified entity for $1.00.” <br /> <br />BEAUDET: I’m okay with the language, you know, and I’m okay with the way the conditions are <br />written. You know, as a developer, I think if the conditions are met in a timely fashion, I think you <br />can set the example for future development, and that’s, you know, that’s a positive way of looking <br />at it, because there has been so many challenges in the past, and, you know, what better place to be <br />than to set the example, or to create that, yeah. And working with your neighbors is a best way to <br />do that. Thank you. <br /> <br />BAKER: Thank you. <br /> <br />BEAUDET: Okay, so just clarifying, there is, only change is to Condition L? <br /> <br />KAY: That’s correct at this point. <br /> <br />BEAUDET: Okay, can you read that just one more time? <br /> <br />KAY: Sure. So that states, “Within one year of the effective date of this amendment, the applicant <br />shall identify an entity that would be responsible for the management and care of the <br />archaeological/cultural features …” and so on. <br /> <br />BEAUDET: Okay.
