As a result Joel dismissed the part two <br />41 from the discussion. <br />42 Joel Cohen then lead the discussion with the Action Committee regarding <br />43 the Planning Director initiated revocation of Use Permit No. 90 (Aina Lea), <br />44 approved by the Planning Commission in 1996. <br />Joel Cohen then made a <br />45 <br />motion for the SKCDPAC to send a letter to the Planning Director in support of <br />46 <br />his 12/15/15 revocation of Aina Lea’s Use Permit No.90, approved by the <br />47 <br />Planning Commission in 1996, based on non-compliance with required <br />48 <br />construction to begin by 12/30/11 and current land use law which now affects <br />49 <br />applicant’s 3000 acres in Waikoloa. Jojo Tanimoto seconded the motion. <br />50 <br />Discussion clarified what part of the development would be covered by the <br />51 <br />revocation of Use Permit No. 90; concerns of the neighboring communities <br />52 <br />regarding the impact of the water usage for the golf course on the aquifer and <br />53 <br />coastal waters; <br />54 Four in favor (Joel, Robby, Jojo, John), and <br />The motion was passed with <br />55 (Roger) abstained. <br /> <br />56 <br /> <br />3.John Mueller lead the discussion with the Action Committee regarding the <br />57 <br />motion for consideration for the Action Committee to forward thru the Planning <br />58 <br />Director to the Planning Commission, via letter, a recommendation to oppose <br />59 <br />Special Management Area Use Permit Application (SMA-15-000061). <br />60 <br />Application is to construct a resort complex consisting of 44-rentable transient <br />61 <br />residential units and related facilities; Change of Zoning Application (REZ-15- <br />62 <br />000196), (V-2a to V-6), TMK (3) 6-9-007:015. Joel Cohen seconded the <br />63 <br />motion. <br />64 <br />Discussion clarified existing entitlements of the property; the development’s <br />65 <br />intent to preserve the trails and shoreline access; generally discussed the studies <br />66 <br />done for the proposed project; clarified the proposed project layout. Concerns <br />67 <br />were raised regarding the trails of the National Parks Service and Na Ala Hele; <br />68 <br />impact of the ocean rising; consultation not made with all relevant <br />69 <br />groups/community members. <br />70 <br />The motion tabled, with the unanimous consent of the committee. Jojo Tanimoto <br />71 <br />made a motion to have a special meeting to continue the discussion next month. <br />72 <br />Robbie Robertson seconded the motion.
