11:22 a.m. The Board returned from brief recess. <br /> Mr. Goodenow: Calling back to order the Board of Ethics meeting. We've already <br /> read into the record, we're on item 5a on the agenda Petition 2015- <br /> 03. My understanding there is a pending motion, but if we could <br /> have our Corporation Counsel kind of give us...confirm where are <br /> we exactly... <br /> Mr. Murai: Chair maybe we should have the parties make their appearances <br /> first. <br /> Mr. Goodenow: Okay. Kohala I believe we have Mr. Hyland...you are there yes? <br /> You can hear us? <br /> Ms. Sweeney: Yes hear loud and clear. <br /> Mr. Eddins: Good morning Board members. My name is Todd Eddins, I'm the <br /> attorney for Mayor William Kenoi. <br /> Mr. Goodenow: Thank you. <br /> Mr. Murai: Okay I see that we have Mr. Hyland by video feed. So Mr. Chair I <br /> just wanted to make sure that we had a clear...we all...parties <br /> included had a clear understanding of where we're at in this <br /> proceeding and so I'm gonna kind of recite the record. 1 guess this <br /> matter Petition No. 2015-03 was filed on April 7, 2010. <br /> Mr. Adams: I'm sorry 2015. <br /> Mr. Murai: I'm sorry 2015. The things...I'm just going over the pleadings that <br /> were filed. There was an email motion for reconsideration and that <br /> email was dated February 4, 2016. Subsequently, there was a letter <br /> from Mr. Hyland dated March 5, 2016 and this is the letter that <br /> asked that...informing the Board that he had recovered from his <br /> illness and he was asking the Board to place the matter back on the <br /> calendar. Then on March 10, there was an addendum...Mr. <br /> Hyland filed an addendum number 1 and 2 and that's dated March <br /> 10, 2016. One more thing, I believe that on May 13, 2105, Mr. <br /> Goodenow made an oral motion for reconsideration and that <br /> motion was...there was a vote to defer that hearing. So hearing on <br /> that motion for reconsideration so my take on that is that unless the <br /> Board votes to put that matter back on...that the matter would stay <br /> deferred unless someone wants to renew the motion or put it back <br /> on the table. Members that's my understanding of the procedurally <br /> where we're at. So unless the Board decides to hear any other pre- <br /> 17 <br />
