Mr. Adams: Point of order. <br /> Ms. Kahakalau: Mr. Adams. <br /> Mr. Adams: We're not in...we're engaging in discussion on something that we <br /> haven't even taken up. We need to do this the right way. <br /> Mr. Goodenow: Well...there's nothing wrong with me asking him if he would <br /> withdraw his petition which I'm trying to do. <br /> Mr. Adams: Point of order. Yes there is. We need to have...just because the <br /> things on the agenda...it's been agendized and we brought it up. <br /> We have yet to actually bring the item forward. So for us to <br /> actually have a conversation on this. We have to have some type <br /> of motion were we've accepted this petition. <br /> Mr. Goodenow: To respond to that...I've always said you need a motion to have <br /> discussion. I've been told with this Board that's not true. We take <br /> testimony or ask questions of the petitioner first and then we make <br /> the motion. So I'm sorry if I didn't follow what I thought was our <br /> procedure. <br /> Mr. Adams: We're having discussion so if the idea is to then go...what you <br /> want to do is initially allow the individual to provide a testimony <br /> and then ask the questions based on the testimony. That's my <br /> understanding of the procedure, but my understanding is that we <br /> haven't yet even determined that we're taking this up as a petition. <br /> Mr. Murai: I would suggest that the first order of business be the Board's <br /> determination whether to accept the petition and then the Board <br /> may have discussion on it. As we speak right now...normally a <br /> petition is regarded filed once the Board accepts it. <br /> Ms. Kahakalau: So in that case...don't we need a motion to do that? <br /> Mr. Murai: Normally...it's kind of a Pro forma thing. In other words going <br /> over whether it meets all the criteria...but in this case...it appears <br /> there may be some deficiencies so therefore I recommend that the <br /> Board...it should probably a motion by motion. <br /> Ms. Kahakalau: So do we have a motion? <br /> Mr. Adams: So I will move that we don't accept this petition in its current form. <br /> Mr. Robinson: And I would second that motion. <br /> 27 <br />
