1. Discussion of Directors letter dated May 9, 2016 to Hiram Rivera, <br />Chairperson of the KCDP AC where the letter serves to rescind the <br />subject title of the February 24, 2016 letter to be replaced by the subject <br />heading INTERPRETIVE DETERMINATION IN LIEU OF LEGAL <br />OPINION. <br /> <br /> Curtis Tyler made a motion to follow the direction of the Director to rescind <br />th <br />the title of the February 24, 2016 letter and to replace the subject heading <br />with Interpretive Determination in Lieu of Legal Opinion. <br /> <br />Curtis Tyler made a motion to approve the motion and Charles Young <br />seconded that motion. The motion was carried unanimously. <br /> <br />2. Discussion on how the Action Committee (AC) is to move forward. <br /> <br /> The Chair, Hiram Rivera stated that there are the three items that the AC <br />sent to the Director detailing how the AC should move forward as listed in <br />lines 160-165 of the April 27, 2016 minutes. The three items include; 1) <br />Providing guidance to the Department if there is a question with whether or <br />not a proposed project, or specific component thereof, is consistent with the <br />applicable section of the KCPD; 2) Providing guidance if there is a <br />disagreement with respect to the applicability of the KCDP between the <br />Department and a developer; and 3) Providing guidance with respect to <br />interpretation of any applicable Goal, Objective and/or Policy. <br /> <br /> It was further proposed by Mr. Rivera that everything is still in place, the <br />County Council reviews all of the specifics on the rezonings of projects and <br />that the AC does not review the project, but that the AC can advise the <br />Director on projects. <br /> <br /> The AC discussed the in general the general aspects of the KCDP that <br />come up during the review of projects, area mitigation, size of the project, <br />consistency with the KCDP of projects, and the ACs interest in reviewing <br />certain projects. <br /> <br /> Mr. Rivera referred to the three items listed in lines 161-165 in the April 27, <br />2016 minutes again and said by following those guidelines from his letter to <br />the Director it should make it easier for the AC to move forward. <br /> <br /> The discussion continued and members of the AC asked Planning Dept. <br />staff on how projects were reviewed for consistency with the KCDP and it <br />was explained that planning staff prepare a report to the Planning <br />Commission on whether a project is consistent with the KCDP and provides <br />a discussion to that extent, and if there is a question on whether the project <br />is consistent, the Planning Department may take the proposed project to the <br />AC for comments. <br /> <br />
