Steering Committee Review of Community Input, September 2016 Review Document 2 of 4 <br />Minor Edits <br />Section 3: Preferred Land Use & Settlement Patterns <br />1. Revise Land Use Policy 7: <br />"In the official Land Use Policy Map for the Hamakua Planning Area, in the "Low Density <br />Urban" (LDU) and Medium Density Urban (MDU) categories, in those cases where provisions <br />of the zoning and subdivision code are inconsistent with the character of surrounding <br />neighborhoods, variances or PUDs that maintain consistent village/town character shall be <br />encouraged." <br />Rationale: The MDU category was inadvertently missing from the previous draft but the intent <br />of preserving town character applies to both LDU and the MDU areas. <br />Section 4: Protect and Enhance Natural & Cultural Resources <br />4.2 Protect Coastal Resources <br />2. Delete County Action Policy 20: <br />peFFn <br />as euFFei tly de -fined ;n Rule 9. <br />Rationale: Policy is now obsolete due to new Dept. of Health rule prohibiting new cesspools. <br />4.8 Establish & Manage Public Access & Trails <br />3. Revise the rationale for County Action Policy 50 to add citation to HRS Sections 46-6.5. <br />4. Add a citation to County Action Policy 52 for HRS171-26. <br />5. Revise the language and rationale for Kokua Action 24 to match source document and cite <br />HRS § 171-26: <br />"Prior to the disposition of any public lands, the board of land and natural resources shall lay <br />out and establish over and across such lands a reasonable number of rights-of-way from <br />established highways to the public beaches, game management areas, public hunting areas, <br />and public forests and forest reserves in order that the right of the people to utilize the public <br />beaches, game management areas, public hunting areas, and public forests and forest <br />reserves shall be protected. <br />Prior to the leasing of any lands, the board shall determine the feasibility of hunting on such <br />lands, and if any of them is suitable for hunting or may during the term of the lease become <br />suitable for hunting, the board may reserve such lands as game management areas or public <br />hunting areas.
